GENERAL TERMS AND CONDITIONS FOR PARTICIPATION IN THE XIII. INTERNATIONAL SYMPOSIUM ON GRAPEVINE BREEDING AND GENETICS


SCOPE

These General Terms and Conditions ("GTC") of the Julius Kühn-Institut (JKI), Institute for Grapevine Breeding Geilweilerhof govern the contractual relationship between the participant and the JKI for participation in the XIII International Symposium on Grapevine Breeding and Genetics (Event).

The GTC are accepted by the participant upon registration and are thus part of the contract.

A. REGISTRATION AND CONCLUSION OF CONTRACT

Registrations for the Event can only be submitted through the designated registration process. The provision of the respective event website with information on the registration procedure does not constitute a binding offer to conclude a contract on the part of the JKI, but merely a non-binding invitation to submit an offer to the JKI. The registration is a binding and irrevocable offer of the participant to the JKI to conclude a contract. Submitting the registration does not constitute a claim to participation in the respective event.

By registering, the participant accepts these GTC and recognises them as binding. Contrary GTC of the participant will only apply to the extent that the JKI has expressly agreed to them in writing.

Registrations will be considered in the order in which they are received. The JKI decides on the acceptance of the offer at its due discretion, taking into account the purpose of the Event and the available capacity.

The contract between the JKI and the participant is only concluded upon confirmation of registration by the JKI or by its agent, CongressCheck GmbH.

An entitlement to participate in the Event exists only after receipt of the full participation amount by the invoicing party and the participant's proof of complete vaccination.

The personal details of the respective participant requested as part of the registration process will be used to record the participant's eligibility and to personalise tickets or the like accordingly. The participant will receive the participant documents (certificate of participation, name badge, etc.) on site, at the conference counter.

Recommendations regarding accommodation and/or arrival and departure options are non-binding recommendations only and do not constitute a legal claim against the JKI.

B. PARTICIPATION FEES

The participation fees stated on the event website are inclusive of the applicable statutory value-added tax. The decisive fees are those stated on the respective event website at the time of registration.

Upon receipt of the invoice, the participation fee is immediately due to be paid to the invoicing party shown on the invoice without deduction.

Discounted registration fees apply for registrations received by 15 April 2022.

The participation fees vary depending on the participation in the programme (participation in the scientific programme, participation as a companion, participation in the conference dinner, participation in the Post Conference Tour). Participation both in the Event and in individual programme items is limited to a certain number of people.

If the minimum number of participants for the planned Post Conference Tour is not reached, the JKI will reserve the right to travel to another growing area and to make a refund if necessary.

C. PARTICIPATION

The participant is obligated to comply with the specifications set by the JKI for the Event. This includes in particular regulatory actions such as hygiene and distance regulations for the course of the Event.

The right to participate in the Event is not transferable. The resale of tickets or similar, whether for private or commercial purposes, is not permitted. In the event of short-term prevention, illness or other cases of undue hardship for the participant, the JKI may, in consultation with CongressCheck GmbH, reassign the right to participate to another person at its discretion. D. CANCELLATION OR NON-PARTICIPATION

In case of non-participation of the participant in the Event, the full participation fee is to be paid, a refund is not possible. In general, if a participant withdraws, a substitute person can be named.

In case of cancellation of the Event by the JKI due to the pandemic, 100 % of the ticket costs will be refunded.

The JKI is entitled to withdraw from the concluded contract with the participant if

a) the participant does not pay the participation fee within the due date and a grace period set for him/her,

b) the participant does not fulfil certain registration requirements (e.g. proof of complete vaccination) after registration and will not be able to fulfil them by the start of the event,

c) the participant violates his obligations under these GTC and/or the house rules and it is unreasonable for JKI to adhere to the contract.

E. COPYRIGHT

Event accompanying documents of the JKI are protected by copyright. This also affects the documents, summaries and information gathered during the event. The participant is exclusively granted a simple, non- transferable right of use for personal use. Any further copying, distribution, storage, making available to the public or reproduction of non-public content is prohibited, as is the removal of technical protection measures or copyright or rights notices, unless the JKI has given its express written consent.

During the Event, the JKI or commissioned third parties, as well as the press and television, may take photographs and film and video recordings of the Event. These recordings may be used and published for press, information and documentation purposes of the JKI. If necessary, consent will be obtained for the making and publication of the recordings.

Information on making photography and film and video recordings will be provided by the JKI at the Event.


F. DATA PROTECTION

JKI and CongressCheck GmbH will process the participant's personal data for the purpose of participation in the Event and the related information in compliance with the applicable Union and national data protection laws. The data will not be disclosed to third parties.

G. LIABILITY

The participant is liable for all damage caused by them, their legal representatives or vicarious agents to facilities and objects of the venue, the JKI or other third parties.

The JKI is not liable for damages. Excluded from this are claims for damages by the participant arising from injury to life, limb or health or from the breach of fundamental contractual obligations as well as liability for other damages based on an intentional or grossly negligent breach of duty by the JKI, its legal representatives or vicarious agents.

Fundamental contractual obligations are those whose fulfilment is essential to the proper performance of the contract and on whose fulfilment the participant relies and may rely.

The aforementioned limitations of liability shall not apply in the case of intent and gross negligence, in the case of mandatory strict liability prescribed by law or liability under a strict warranty.

J. APPLICABLE LAW

The law of the Federal Republic of Germany shall apply to all legal relationships between the parties to the exclusion of international uniform law, in particular the UN Convention on Contracts for the International Sale of Goods.

K. JURISDICTION

The exclusive place of jurisdiction is Landau / Pfalz.

L. FINAL PROVISIONS

Amendments and supplements to these GTC as well as to the contractual relationships concluded under their inclusion – including any ancillary agreements – require a written agreement and the express indication that it is an amendment or supplement. This also applies to the waiver of this formal requirement.

Should individual provisions be or become invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. In place of an invalid or unenforceable provision, the provision that comes closest to the economic intent of the parties shall be deemed agreed. The same applies in the event of a regulatory gap.
